Ousted MP Nalukoola Appeals Court Ruling Nullifying Kawempe North Victory

Elias Lukwago Nalukoola, recently removed from his seat as Kawempe North MP, has officially filed a notice of appeal challenging the High Court ruling that invalidated his March 2025 parliamentary victory. The appeal, submitted to the Court of Appeal on June 10, 2025, seeks to overturn the decision by Justice Bernard Namanya, who nullified Nalukoola’s election over proven misconduct and ordered fresh elections.

Nalukoola, a National Unity Platform (NUP) member, rose to Parliament following a by-election prompted by the death of former MP Muhammad Ssegirinya. However, his win was successfully contested by NRM candidate Faridah Nambi, who accused him of election law violations. Justice Namanya found that Nalukoola had personally campaigned at polling stations on voting day—an act prohibited by electoral law.

The judge also faulted the Electoral Commission for failing to tally votes from 14 polling stations, leaving over 16,000 voters—among them the petitioner—disenfranchised. He concluded that the scale of irregularities compromised the election’s credibility and integrity.

With Nalukoola’s appeal now before the Court of Appeal, the final outcome could either reinstate him or clear the path for a new by-election. The Electoral Commission has yet to set a new date, pending the appeal’s resolution. His case reflects broader post-election legal battles facing NUP, underscoring ongoing tensions in Uganda’s political and electoral landscape.
